TMS360, operated by 4 Freight Inc. (“Company,” “we,” “us,” or “our”), is committed to protecting your privacy. This policy describes the types of information we may collect from you or that you may provide when you use our transportation management platform at www.tms360.io (the “Platform”), our mobile applications, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

On the Platform and our website
In email, text, and other electronic messages between you and the Platform
Through our mobile applications (including the TMS360 Driver App)
When you interact with our advertising or applications on third-party websites and services

It does not apply to information collected by any third party, including through any application or content that may link to or be accessible from the Platform.

Please read this policy carefully. By accessing or using the Platform, you agree to this privacy policy. If you do not agree with our policies and practices, do not use the Platform. This policy may change from time to time (see Changes to This Policy). Your continued use after changes constitutes acceptance.

2. Children Under the Age of 18

The Platform is not intended for children under 18 years of age. No one under age 18 may provide any information to or on the Platform. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Platform. If we learn we have collected personal information from a child under 18 without verification of parental consent, we will delete that information. 3. Information We Collect

We collect several types of information from and about users of the Platform:

Information You Provide to Us

Account information: name, email address, company name, MC/DOT number, phone number, fleet size, and entity type (carrier/broker)
Operational data: rate confirmations, load details, shipment records, trip information, driver information, team structures, and dispatch records
Documents: BOLs, PODs, rate cons, insurance certificates, and other files you upload
Financial information: billing details, charges, settlement records, and payment information
Communications: records and copies of your correspondence with us, including emails and support requests
Survey responses: information you provide in response to surveys or feedback requests

Information Collected Automatically

As you navigate and interact with the Platform, we automatically collect:

Usage data: features used, pages visited, actions taken, traffic data, and the resources you access
Device information: IP address, browser type, operating system, device identifiers, and screen resolution
Location data: GPS coordinates from the Driver App (with your permission), and approximate location from IP address
Log data: access times, referring URLs, and error logs

Information from Third Parties

FMCSA data: publicly available carrier and broker records used for authority verification
Telematics providers: GPS and vehicle data from Samsara, Motive, or other connected services

4. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect and track information and to improve the Platform. Technologies we use include:

Cookies: small files placed on your device. You may refuse browser cookies by adjusting your browser settings, but some parts of the Platform may become inaccessible or not function properly.
Web beacons: small electronic files (also called clear gifs or pixel tags) on pages of the Platform and in emails, used to count users, track page visits, and measure email engagement.
Analytics tools: we use third-party analytics services to understand usage patterns and improve the Platform.

Some content or applications on the Platform may be served by third parties that use their own cookies or tracking technologies. We do not control these third-party technologies. If you have questions about targeted content, contact the responsible provider directly.

5. How We Use Your Information

Provide, operate, and maintain the TMS360 platform
Process rate confirmations using AI extraction
Verify carrier/broker authority via FMCSA data
Manage your dispatch operations, teams, loads, and fleet
Store and organize your documents securely
Process driver location data for trip tracking and geofence verification
Send service-related communications, including account notices and security alerts
Provide customer support and respond to your requests
Improve the Platform, develop new features, and analyze usage patterns
Detect, prevent, and address technical issues, fraud, and security threats
Comply with legal obligations
For any other purpose with your consent

We may use your information to contact you about our products and services that may be of interest to you. You can opt out of marketing communications at any time (see Your Rights).

6. AI Processing

Our AI extraction feature processes rate confirmation documents to extract load details. Documents are sent to third-party AI providers (Google and Anthropic) for processing. We do not use your documents to train AI models. Extracted data is stored in your company account and is not shared with other users or companies.

AI extraction is provided on a best-effort basis. While we target high accuracy, you are responsible for reviewing extracted data before acting on it.

7. Data Sharing and Disclosure

We do not sell your personal information. We may disclose aggregated, de-identified information without restriction. We share personal data only in the following circumstances:

Service providers: cloud hosting (Railway), AI processing (Google, Anthropic), geocoding and routing (HERE Maps), email services, and analytics providers — bound by contractual obligations to keep data confidential
FMCSA: for carrier/broker authority verification (public data)
Telematics partners: Samsara, Motive, and other GPS/ELD providers you connect
Business transfers: in connection with any merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the acquiring entity
Legal requirements: when required by law, regulation, court order, or legal process
Protection of rights: when we believe disclosure is necessary to protect the rights, property, or safety of 4 Freight Inc., our users, or the public
With your consent: for any other purpose you authorize

8. SMS and Mobile Communications

If you opt in to receive SMS or push notifications from TMS360, we will use your mobile number solely for delivering TMS360-related communications (dispatch alerts, trip updates, security codes). We do not share, sell, or disclose mobile opt-in information with third parties or affiliates. You may opt out at any time by replying STOP or adjusting your notification settings.

9. Data Security

We implement industry-standard security measures including encrypted data transmission (TLS), JWT-based authentication with RSA-256 signing, company-scoped data isolation, and secure cloud infrastructure. All operational data is logically separated by company.

The safety and security of your information also depends on you. Keep your account credentials confidential and do not share them with unauthorized parties. Notify us immediately of any unauthorized access.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of information transmitted to the Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

10. Data Retention

We retain your data for as long as your account is active or as needed to provide you services. Upon account deletion, we remove your personal data within 30 days, except where retention is required by law, for legitimate business purposes (e.g., audit records, legal claims), or to comply with contractual obligations.

Copies may remain temporarily in system backups before being fully purged in accordance with our internal data lifecycle policies.

11. Your Rights

You may:

Access, correct, or delete your personal data
Export your data in a standard format
Opt out of marketing communications
Request information about data processing
Withdraw consent for optional data collection (e.g., location tracking)
Set your browser to refuse cookies (some features may be affected)

12. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (CCPA) may provide you with additional rights regarding our use of your personal information, including:

Right to know: you may request that we disclose what personal information we have collected, used, disclosed, and sold about you
Right to delete: you may request deletion of your personal information, subject to certain exceptions
Right to opt out: you may opt out of the sale of your personal information (we do not sell personal information)
Right to non-discrimination: we will not discriminate against you for exercising your CCPA rights

California's “Shine the Light” law (Civil Code Section 1798.83) permits California residents to request information regarding our disclosure of personal information to third parties for direct marketing purposes. To make such a request, contact us at [email protected].

We may update this policy periodically. We will post any changes on this page with an updated revision date. If we make material changes to how we treat your personal information, we will notify you via email or in-app notification. Your continued use of TMS360 after changes constitutes acceptance.
